Terms of Use Agreement

Welcome to Blue Plate. These Terms of Use ("Agreement") govern your access to and use of our website, mobile application, and services (collectively, the "Service"). By accessing or using Blue Plate, you agree to be bound by these terms. If you do not agree to these terms, please do not use our Service.

Blue Plate reserves the right to update these Terms of Use at any time. Your continued use of the Service following the posting of revised terms means you accept the changes. We will notify you of material changes via email or prominent notice on our website.

1. Eligibility and Account Registration

Eligibility Requirements

You must be at least 18 years old and a legal resident of the United States to use Blue Plate. By using the Service, you represent and warrant that you meet these requirements. We do not knowingly provide services to minors under 13 years old.

Account Registration

To place orders, you may need to create an account. You agree to:

  • •Provide accurate, complete, and current information
  • •Maintain the confidentiality of your password
  • •Accept responsibility for all activities under your account
  • •Notify us immediately of any unauthorized access

2. Ordering Process

When you place an order through Blue Plate:

  • •You are making an offer to purchase items at the listed price
  • •Blue Plate reserves the right to accept or reject any order
  • •An order confirmation will be sent when we accept your order
  • •Prices are subject to change without notice until your order is confirmed
  • •All prices include applicable taxes and fees unless otherwise stated
  • •You agree to pay all charges using a valid payment method

3. Refund & Cancellation Policy

Cancellations

You may cancel your order under the following conditions:

  • •Cancellations must be requested within 5 minutes of order placement
  • •Once the restaurant has confirmed and begun preparing your order, cancellation is not available
  • •Approved cancellations will receive a full refund within 3-5 business days
  • •Delivery fees are non-refundable once the driver has been dispatched

Refund Eligibility

Refunds will be issued for the following reasons:

  • •Quality Issues: Incorrect items, missing items, or food quality problems reported within 2 hours of delivery
  • •Delivery Issues: Non-delivery within the agreed timeframe (refund minus delivery fee)
  • •Payment Errors: Double-charging or other payment processing errors
  • •Service Unavailability: Technical issues preventing order completion

Non-Refundable Items

The following are non-refundable: completed orders for consumption (even if partially eaten), delivery fees once driver is en route, promotional credits (unless the promotion is canceled), and orders where you were provided the items as agreed.

How to Request a Refund

To request a refund, contact us through the app or website with your order number, reason for the refund, and supporting details. We will respond within 24 business hours. Refunds are processed to the original payment method within 3-5 business days.

4. Delivery Terms

Delivery Availability

  • •Delivery is available to addresses within our service areas as displayed in the app
  • •Estimated delivery times are approximations and not guaranteed
  • •Delivery times may vary due to traffic, weather, restaurant preparation time, and other factors
  • •We are not responsible for delays beyond our reasonable control

Delivery Address

You are responsible for providing a complete and accurate delivery address. We are not responsible for orders delivered to an incorrect address provided by you. If your order cannot be delivered due to an incorrect address, you must bear the cost of redelivery or coordinate a pickup.

Access & Safety

You must ensure the delivery location is accessible and safe for our drivers. This includes providing gate codes, parking instructions, and ensuring dogs or other animals do not pose a safety risk. You are responsible for any injuries or property damage caused by pets or unsafe conditions you fail to disclose.

Proof of Delivery

Once a driver confirms delivery, the order is considered delivered. You are responsible for inspecting items immediately upon delivery and reporting any issues within 2 hours.

Driver Conduct

Our drivers are independent contractors or employees bound by our policies. You agree to treat them with respect. Abusive, harassing, or threatening behavior toward drivers may result in account termination and may violate local laws.

5. Allergen & Dietary Information Disclaimer

Blue Plate takes allergen safety seriously. Our menu items are clearly labeled with allergen information including the FDA's Big 9 allergens: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, and sesame.

IMPORTANT ALLERGEN DISCLAIMER

Despite our best efforts to prevent cross-contamination, our kitchens are not allergen-free facilities. Cross-contamination may occur during food preparation, handling, and serving. If you have a severe food allergy, please inform us during ordering and consider consulting with a medical professional before consuming any items from Blue Plate.

Blue Plate is not liable for allergic reactions or health issues resulting from consumption of our food items, including those caused by undisclosed cross-contamination.

You may notify us of allergies or dietary restrictions during the ordering process. We will make reasonable efforts to accommodate your needs, but cannot guarantee absolute prevention of allergen exposure.

6. User Conduct & Prohibited Behavior

You agree not to use Blue Plate for any unlawful purposes or in any way that violates these Terms. Specifically, you agree not to:

  • •Harass, threaten, abuse, or discriminate against any person (including drivers, staff, or other users)
  • •Provide false or misleading information
  • •Make fraudulent refund claims
  • •Attempt to manipulate or hack the Service or its systems
  • •Use the Service to promote illegal activities or substances
  • •Share your account credentials with others
  • •Post obscene, offensive, or discriminatory content
  • •Use the Service for commercial purposes or scraping data

Violation of these conduct rules may result in account suspension or termination, legal action, and reporting to law enforcement where appropriate.

7. Intellectual Property Rights

All content on Blue Plate, including text, graphics, logos, images, videos, and software, is the property of Blue Plate or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view and use the Service for personal, non-commercial purposes only. You may not:

  • •Reproduce, distribute, or transmit any content without permission
  • •Modify, translate, or create derivative works
  • •Use the Blue Plate name or logo without permission

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE PLATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BLUE PLATE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS SERVICE EXCEED THE AMOUNT YOU PAID FOR THE ORDER IN QUESTION, OR $100, WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Dispute Resolution & Governing Law

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Blue Plate operates in California and serves California customers.

Jurisdiction & Venue

You agree that any dispute, claim, or cause of action arising out of or relating to the Service shall be brought exclusively in the state and federal courts located in California, and you consent to the personal jurisdiction and venue of such courts.

Dispute Resolution Process

Before pursuing formal legal action, we encourage you to contact us at petaluma@blueplate.com to attempt to resolve any dispute informally.

If we cannot resolve your dispute within 30 days, either party may pursue further legal remedies as permitted by law.

No Class Actions

You agree that any legal action or proceeding shall be conducted on an individual basis and not as a class action or collective action.

10. Indemnification

You agree to indemnify and hold harmless Blue Plate and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Service, or any injury or property damage caused by you or your conduct.

11. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms of Use, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Blue Plate regarding the Service and supersede all prior agreements and understandings. No oral representations or agreements are binding.
